Terms of Service

1. Agreement
These terms govern your use of the Presence clipper platform (the “Service”), operated by Presence (presence-agency.com). By creating an account or using the Service you agree to these terms. If you do not agree, do not use the Service.
2. The Service
Presence connects content creators (“clippers”) with promotional campaigns. Through the Service you can join campaigns, submit clips you have published on social platforms, track their performance, and request payouts for eligible views.
3. Eligibility & accounts
You must be at least 18 years old. You sign in with a third-party identity provider (Discord or Google) and are responsible for activity on your account. Provide accurate information and keep your linked accounts under your control.
4. Connected social accounts
You may connect social accounts (such as YouTube, TikTok or Instagram) via their official authorization flows. You must only connect accounts you own. Authorization is used to verify your identity and to read public profile and statistics data needed to attribute and measure your clips. You can disconnect an account at any time from the Accounts page or by revoking access in the social platform’s settings.
5. Content rules
Clips you submit must comply with each campaign’s brief, the rules of the platform they are published on, and applicable law. Artificially inflated views (bots, view farms, engagement manipulation) are prohibited and forfeit related payouts.
6. Payouts
Campaigns state their own rates (typically per thousand eligible views) and budgets. Views are validated by Presence before payment. Payouts are made to the payment method you register, as an independent contractor; you are responsible for your own taxes. Fraud, rule violations or campaign cancellation may void pending payouts.
7. Intellectual property
Campaign source material remains the property of its owners and is licensed to you only to create clips for that campaign. You retain rights you hold in your clips. Presence retains all rights in the Service itself.
8. No guarantees & liability
The Service is provided “as is”. We do not guarantee campaign availability, view counts or earnings. To the extent permitted by law, Presence’s liability is limited to the amounts payable to you for the campaign concerned.
9. Termination
You may stop using the Service at any time. We may suspend or terminate accounts that break these terms. Validated, unpaid payouts earned before termination remain payable unless obtained fraudulently.
10. Changes & law
We may update these terms; material changes will be announced in the app. These terms are governed by French law. Questions: contact@presence-agency.com.
